1. Overview and Scope
This Privacy Policy explains how AuctionWarriors (“AuctionWarriors,”
“we,” “us,” or “our”) collects, uses, shares, and protects
information when you use our websites, apps, and related services (collectively, the
“Service”), including when you browse vehicle listings, create an account,
submit Max Bids, make payments, request refunds, arrange transportation, or otherwise
interact with us.
This Privacy Policy applies to information we process in connection with the Service.
It does not apply to third-party websites, auction sources, carriers, government
agencies, or payment providers you may interact with outside our Service. If you
choose a third-party service (for example a self-transporter, or a government portal),
their privacy practices apply to your dealings with them.
The Service is intended for users who are 18 years of age or older. We do not
knowingly collect personal information from children under 18.
For privacy questions or requests (including access or deletion requests, where
applicable), contact us at
help@auctionwarriors.com and include
the email address associated with your account.
2. Information We Collect
We collect information in three main ways: (a) information you provide to us,
(b) information collected automatically when you use the Service, and
(c) information from service providers and other sources used to operate the Service.
2.1 Information You Provide
Depending on how you use the Service, you may provide:
- Account and profile information: name, email address, phone number, password or authentication information, business name (if applicable), and other account details.
- Preferences and saved items: likes, favorites, hidden vehicles, saved searches, watchlists, alerts, notification preferences, and other preference settings.
- Transaction and bidding activity: Max Bids you submit, bid attempts, bid failures/errors, award outcomes, purchases, invoices, payment selections, refund requests, and other transaction activity in the Service.
- Search and browsing activity you generate: search terms, search history, filter selections and filter history, sorting preferences, vehicle pages viewed, clicks, and other interaction history tied to your account.
- Log and account activity: login/logout activity, session activity, device changes (where available), and records of changes you make to account information (for example, profile updates, contact info updates, settings changes).
- Delivery and logistics information: delivery addresses, delivery recipients, transporter details (if self-transport), and other pickup/delivery instructions.
- Support and communications: messages and submissions through the Service; emails, chat messages, and other written communications; and, where permitted by law, records or notes of phone calls and the information you provide during calls (including contact history and support history).
- Identity verification information (planned/when enabled): if identity verification is made available or required, we may collect government-issued ID information and related details (which may include date of birth) and other verification information as necessary for fraud prevention, compliance, or account protection.
2.2 Information Collected Automatically
When you access or use the Service, we may automatically collect:
- Device and usage data: IP address, browser type, device identifiers, operating system, referral URLs, pages viewed, clicks, timestamps, and other activity data.
- Cookies and similar technologies: we use cookies, pixels, local storage, and similar technologies to operate the Service, remember preferences, improve performance (including caching and load optimization), measure traffic, and support advertising/retargeting where enabled.
- Analytics data: we use analytics tools such as Google Analytics to understand how visitors use the Service and to improve features and performance.
- Fraud and security signals: we may collect and use signals associated with fraud prevention and risk management, which may include device identifiers, behavioral signals, and related risk indicators.
We do not collect precise geolocation (such as GPS-level location) through the Service.
2.3 Information From Payment and Service Providers
To process payments and operate the Service, we may receive information from third
parties, including:
- Payment processing: payments are processed through Stripe and related payment partners. We receive information such as payment confirmation, payment method type, billing details (where provided), partial card details (for example, last four digits), and transaction status. We do not store full card numbers ourselves.
- Bank account payment initiation (when available): if bank-transfer payment methods are available to you through our Service, we may use Plaid or similar providers to help connect your bank account for payment initiation. We may receive limited information needed to facilitate the payment (for example, account verification signals and payment status). Your bank credentials are handled by Plaid and/or your bank under their terms and privacy practices.
2.4 Information About Vehicles and Listings
We display vehicle listings and related information sourced from third parties (such
as auction houses, suppliers, sellers, yards, and other inventory sources) including
vehicle attributes, photos, and auction-related data. This vehicle/listing information
is not your personal information by itself, but it may be linked to your account
activity (for example, viewing history, searches, Max Bids, or purchases).
We do not provide your personal information to an auction house or other inventory
source for the purpose of your purchases through AuctionWarriors, and auction houses
and sources generally do not know you as the buyer in transactions initiated through
AuctionWarriors.
3. How We Use Information
We use the information we collect to operate, improve, secure, and provide the
Service. In particular, we may use information to:
- Provide and operate the Service: create and manage accounts, authenticate users, enable access to features, display inventory and account dashboards, process Max Bids, manage awards and purchases, issue invoices, and provide customer support.
- Process payments and refunds: facilitate payments and refunds, apply Account Credit, manage Refundable Deposits, detect and prevent payment fraud, address chargebacks and disputes, and maintain transaction records.
- Arrange logistics and fulfillment: coordinate vehicle release and delivery (including sharing necessary details with carriers and service providers you select or we arrange), manage delivery addresses and recipients, and communicate about pickup, delivery, and scheduling.
- Email delivery providers: to send transactional emails and service notifications (and, where permitted, marketing emails). This may include sharing your email address and message content with our email delivery vendors.
- Personalize your experience: remember preferences, saved items, likes/hidden lists, searches and filters, recommended vehicles, and other settings; and tailor content and features based on your activity.
- Improve performance and functionality: monitor performance, debug issues, prevent outages, support caching and load optimization, analyze usage patterns, test and develop new features, and maintain system integrity.
- Analytics and measurement: understand how visitors and members use the Service, measure traffic and engagement, and evaluate marketing performance, including through tools such as Google Analytics.
- Advertising and marketing: send service-related messages (such as confirmations, notices, security alerts, and billing communications), and where permitted by law and consistent with your preferences, send marketing communications and display interest-based advertising (including retargeting) on third-party platforms.
- Fraud prevention, security, and compliance: verify accounts where needed, detect and prevent fraud and abuse, protect AuctionWarriors and users, enforce our Terms, comply with legal obligations, respond to lawful requests, and maintain audit logs and security records.
- Legal and business purposes: resolve disputes, collect amounts owed, protect rights and property, maintain records for accounting and tax purposes, support corporate transactions (such as financing, mergers, or acquisitions), and otherwise operate our business.
We may use aggregated or de-identified information (information that does not
reasonably identify you) for analytics, research, and business purposes.
4. How We Share Information
We do not sell personal information for money. We share personal information only as
described below, including when necessary to operate the Service, complete
transactions, secure the platform, comply with law, or support advertising and
analytics.
4.1 Service Providers and Vendors
We may share personal information with vendors and service providers that perform
services on our behalf, such as:
- Payment processing and banking partners (for example Stripe and, when available to you, Plaid) to process payments, refunds, and fraud checks.
- Analytics providers (for example Google Analytics) to measure and improve usage and performance.
- Infrastructure and security providers (such as hosting, storage, logging, monitoring, customer support systems, and fraud-prevention tools) to run and secure the Service.
- Communications providers (email, SMS, and phone support tools) to send account notices, invoices, security messages, and other communications.
These providers are authorized to use personal information only as necessary to
provide services to us, subject to appropriate contractual protections.
4.2 Transportation, Logistics, and Delivery
If you choose AW-arranged transportation or otherwise request logistics support, we
may share information necessary to coordinate pickup and delivery with carriers,
dispatchers, towing companies, yards, and other logistics providers. This may include
your name, phone number, delivery address, designated recipient, and vehicle/purchase
identifiers. If you choose self-transport, we may share necessary release/pickup
details with the transporter information you provide.
4.3 Advertising and Marketing Partners
We may share limited information with advertising and marketing partners to measure
advertising performance and to deliver interest-based advertising (also called targeted
advertising or retargeting), subject to applicable law and your choices. This sharing
may occur through cookies, pixels, and similar technologies on our Service and may
involve partners that help us run campaigns and measure conversions.
Depending on where you live, this type of sharing may be considered “sharing”
personal information for cross-context behavioral advertising (even if no money is
exchanged). Where required, we provide choices to opt out of this type of sharing.
4.4 Legal, Safety, and Rights Protection
We may share information if we believe in good faith that it is necessary to:
- comply with law, regulation, court orders, subpoenas, or lawful requests;
- protect the rights, property, and safety of AuctionWarriors, our users, partners, service providers, or the public;
- detect, prevent, investigate, or address fraud, security issues, or prohibited conduct;
- enforce our Terms and agreements; or
- respond to disputes, chargebacks, or claims.
4.5 Business Transfers
If AuctionWarriors is involved in a merger, acquisition, financing, reorganization,
bankruptcy, or sale of some or all of its assets, information may be transferred as
part of that transaction, subject to standard confidentiality protections.
4.6 With Your Direction or Consent
We may share information when you direct us to (for example, adding a delivery
recipient or providing transporter information) or when you otherwise consent.
5. Cookies, Tracking Technologies, Caching, and Your Choices
5.1 Cookies and Similar Technologies
We use cookies and similar technologies (such as pixels, tags, SDKs, and local
storage) to operate the Service, remember preferences, enhance security, measure
performance, and support analytics and advertising.
Cookies are small text files stored on your device by your browser. They can help the
Service remember things like your login status, settings, and preferences, and they
can be used for analytics and advertising measurement.
We use both:
- Essential cookies/technologies that are needed to provide core functionality (such as account access, security, and fraud prevention); and
- Non-essential cookies/technologies that support analytics and advertising (such as measuring site traffic, conversions, and retargeting).
5.2 Caching (Performance Optimization) vs. Cookies
Caching is a performance technique used to make the Service load faster and more
reliably. Caching may involve storing copies of certain content (such as pages,
images, scripts, or API responses) temporarily on servers, content delivery networks,
or on your device’s browser cache.
Caching is not the same as cookies:
- Caching stores copies of content to speed up loading.
- Cookies store small pieces of information that can identify a browser/session and remember preferences or enable analytics/ads.
5.3 Analytics
We use analytics tools such as Google Analytics to understand how people use the
Service, improve features, and measure performance. Analytics tools may use cookies or
similar technologies to collect usage and device data.
5.4 Advertising and Retargeting
We may allow advertising partners to use cookies, pixels, and similar technologies to
help us:
- measure ad performance (such as conversions);
- show you AuctionWarriors advertising on other websites/apps; and
- deliver interest-based advertising (retargeting), subject to applicable law and your choices.
Depending on where you live, this may be treated as “sharing” personal
information for cross-context behavioral advertising even if we do not sell your
personal information for money.
5.5 Your Choices
Your choices may include:
- Browser controls: Most browsers let you remove or block cookies. If you block certain cookies, some Service features may not work properly (including login and security features).
- Device settings: Your device may provide controls for advertising identifiers (for example, limiting ad tracking).
- Advertising opt-outs: You may be able to opt out of interest-based advertising through industry programs and platform settings.
- Do Not Track: Some browsers offer “Do Not Track” signals. Because there is no consistent industry standard for responding, we may not respond to all DNT signals.
Where required by law, we provide additional choices and disclosures, including opt-out
rights for certain types of targeted advertising and sharing.
6. Data Retention
We retain personal information for as long as reasonably necessary to provide the
Service, maintain accurate business records, comply with legal obligations, resolve
disputes, enforce our agreements, and protect AuctionWarriors and our users.
Retention periods vary depending on the type of information and why we collected it.
For example:
- Account information is typically retained while your account is active and for a reasonable period afterward to support account recovery, fraud prevention, compliance, and recordkeeping.
- Transaction and billing records (including invoices, payments, refunds, Account Credit, Refundable Deposits, fees, penalties, and related logs) may be retained for longer periods as required for accounting, tax, regulatory compliance, chargeback/dispute handling, and enforcement.
- Security, fraud-prevention, and audit logs (including login/logout activity, device/security signals, and records of account changes) may be retained to detect abuse, prevent fraud, maintain platform integrity, and comply with legal requirements.
- Communications and support history (including emails, messages, and where permitted by law, call records or notes) may be retained to provide support, improve operations, maintain quality, document instructions, and resolve disputes.
- Marketing and analytics data may be retained in accordance with our operational needs and the settings offered by our analytics and advertising partners.
When we no longer need personal information for the purposes described in this Privacy
Policy, we take reasonable steps to delete it, de-identify it, or securely store it
until deletion is appropriate, unless we are required or permitted by law to retain it
longer.
7. Security
We use administrative, technical, and physical safeguards designed to protect personal
information from unauthorized access, use, alteration, and disclosure. These safeguards
may include access controls, encryption in transit where supported, monitoring,
fraud-prevention measures, and security logging.
However, no method of transmission or storage is 100% secure. You are responsible for
maintaining the confidentiality of your account credentials and for using the Service
in a secure manner. If you believe your account has been compromised, contact us
promptly.
8. Your Rights and Choices
Depending on where you live, you may have certain rights and choices regarding your
personal information. We also provide choices to all users as described below.
8.1 Marketing Communications
- Email marketing: You can opt out of marketing emails by using the unsubscribe link in those messages. Even if you opt out of marketing, we may still send transactional or service messages (e.g., purchase updates, invoices, receipts, security alerts).
- SMS/text (if used): You can opt out by following the instructions in the message.
8.2 Cookies, Analytics, and Targeted Advertising Choices
- Cookies: Most browsers let you remove or block cookies. Some parts of the Service may not work properly if you block certain cookies (e.g., login/security features).
- Google Analytics: You can opt out of Google Analytics tracking using Google’s opt-out browser add-on.
- Targeted advertising / retargeting: Depending on your location, you may have the right to opt out of targeted advertising (also called cross-context behavioral advertising). We will honor applicable opt-out requests using the methods we provide in the Service (for example, an account setting, a cookie banner, or an opt-out link), where required.
8.3 U.S. State Privacy Rights (Including California)
If you are a resident of a state with a consumer privacy law (including California),
you may have some or all of the following rights, subject to legal exceptions:
- Right to know/access what personal information we collect, use, and share.
- Right to delete personal information we collected from you (subject to exceptions, such as security, fraud prevention, legal compliance, and transaction recordkeeping).
- Right to correct inaccurate personal information.
- Right to opt out of “sale” or “sharing” of personal information (in California, “sharing” includes certain targeted advertising uses).
- Right to limit the use/disclosure of sensitive personal information (where applicable).
- Right to non-discrimination for exercising privacy rights (we will not unlawfully deny services, charge different prices, or provide a different quality of service solely because you exercised a privacy right).
Because privacy laws are evolving and vary by state (including new requirements in some
states starting in 2026, such as recognizing certain universal opt-out mechanisms), we
may provide additional state-specific disclosures or choices when required.
9. How to Exercise Your Rights
To make a privacy request, contact us at
help@auctionwarriors.com from the email
address associated with your account and include:
- your full name,
- the email/phone on your account, and
- the request you’re making (access, deletion, correction, opt-out, etc.).
Verification: To protect you and prevent fraud, we may need to verify
your identity before fulfilling certain requests. We may deny requests that we cannot
verify or that are subject to legal exceptions.
Authorized agents (where applicable): If your state allows you to use
an authorized agent, we may require proof of authorization and may still need to
verify your identity directly.
10. International Users and Cross-Border Transfers
AuctionWarriors is based in the United States and the Service is primarily intended
for users in the United States and other jurisdictions where we operate. If you access
or use the Service from outside the United States, you understand that your personal
information may be transferred to, processed in, and stored in the United States and
other countries where we or our service providers operate.
Privacy laws in the United States and other countries may differ from the laws in your
place of residence. Where required by applicable law, we will take reasonable steps
designed to ensure an appropriate legal basis and safeguards for cross-border transfers
(for example, contractual protections with service providers and security measures
appropriate to the nature of the data).
11. Updates to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to our
practices, technologies, legal requirements, or the Service. When we update it, we
will revise the “Last Updated” date at the top of the Privacy Policy and post
the updated version on the Service. If changes are material, we may provide additional
notice as required by law (for example, by email or through the Service).
Your continued use of the Service after an update becomes effective means you accept
the updated Privacy Policy, to the extent permitted by law.
12. Contact Us
If you have questions about this Privacy Policy or our privacy practices, or if you
want to exercise your privacy rights (where applicable), contact us at:
Email: help@auctionwarriors.com
To help us process your request, please email us from the email address associated
with your account and include a clear description of your question or request. We may
